VENDOR AGREEMENT FORM:

ATLANTIC CITY BAZAAR 2022

By signing up as a vendor to the Asbury Park Bazaar, you agree to the following:

1.ORGANIZATION:

"Atlantic City Bazaar is run by Asbury Park Bazaar, LLC”

2. DATES, LOCATIONS & HOURS:

Please refer to your vendor invitation email.

3. By signing up as a vendor and signing below you acknowledge the your understanding and agreement to adhere to all Asbury Park Bazaar's rules and regulations.

4. Regulations & Licenses: Vendors are responsible for compliance with applicable municipal, county, state and federal regulations.

5. No peddlers or unauthorized vendors will be permitted at the Bazaar.

6. SAFETY

Our goal is to provide a positive, safe experience for all. We will be following COVID-19 state, county and city guidelines required at the time of the event.

7. VENDOR SPACE

Vendor load in begins at 10 am. Vendors must have their display ready for sale at 12 pm. All spaces are 6' x 4'. All vendors are to bring your own table, chairs, and all display needs. Please do not set up outside of the boundaries of your space. Vendors are not able to share spaces unless you are a collaborative business/team then please only submit one application.

Power will be available where possible. Vendors must bring their own lights (LED required, no incandescents allowed), and any necessary extension cords, surge protectors, splitters as needed for operation. Electric provided is standard 110 voltage for basic needs.

The Bazaar will run rain or shine unless under dangerous weather conditions. There are no refunds due to rain/weather.

All vendors are expected to remain on site for duration of the Bazaar until close of business at 5:00 pm and provide ample product for the duration of the event.

Each seller must have a sign plainly visible identifying vendor name.

Each vendor is responsible to maintain an aesthetically pleasing, clean and neat sales and work area, and thoroughly clean up the booth area when finished selling for the day (5 pm). We recommend disinfecting your display before, during and after the Bazaar.

Paper bag, biodegradable plastic bag, and/or newsprint or butcher paper use is encouraged and preferred as customer packaging rather than single use plastic bags. You can also sell reusable branded bags on site.

Please abide by social distancing and/or CDC prefered guidelines and ask your customers to as well. Try to allow space for the transfer of goods while continuing physical distancing to the best of your ability.

8. VENDOR LOAD IN & LOAD OUT

All vendor load in and out instructions will be provided in your vendor packet email the week before the show.

Vendors will receive a vendor map indicating their location a few days before the event. You can also check in with our Bazaar manager if you have trouble finding your space.

In the case that you will be late or absent, due to weather or illness (please follow CDC guidelines for staff illness in relation to COVID-19 - please stay home if you/your staff is feeling ill), please notify Asbury Park Bazaar at asburyparkbazaar@gmail.com as early as possible.

All vendors must close up business at the end of the event at 5 pm and be loaded out no later than 6:30 pm.

Vendors may not leave any tents, displays, tables, chairs, or any items if you are selling on both Sat / Sun. The Bazaar can't ensure its safety after we close the event at 5 pm as Bourre is a bar and restaurant open to the public. There is no security. The Bazaar nor Bourre are responsible for any items you leave behind. By signing this agreement, you agree to hold harmless Asbury Park Bazaar against any losses or damages. 9. REFUND POLICY.

If there is a cancellation by the vendor: If a Vendor needs to cancel, they must notify Asbury Park Bazaar by email to team@asburyparkbazaar.com. If cancellation notification is received more than 15 days before the vendor sell date, Vendor will receive a 50% refund. Any cancellations less than 15 days before the vendor sell date will not receive a refund. By cancelling, Vendor forfeits their spot at Atlantic City Bazaar.

If there is a cancellation by Asbury Park Bazaar: If a cancellation of Atlantic City Bazaar is necessary due to unforeseen circumstances, acts of a third party, or other circumstances which (in Asbury Park Bazaar's sole judgement) may compromise the safety of vendors and participants, vendors will receive a 50% refund.

If there is a cancellation by venue: If a cancellation of Atlantic City Bazaar is necessary due to unforeseen circumstances, acts of a third party, or other circumstances which (in venue's sole judgement) may compromise the safety of vendors and participants, vendors will receive a 50% refund.

INDEMNITY AGREEMENT

To the fullest extent permitted by law, I agree to defend, pay on behalf of, Indemnify and hold harmless Asbury Park Bazaar and The Showboat Atlantic City, Its elected and appointed officials, its agents, employees and volunteers, and Atlantic City Bazaar and its’ members against any and all claims, demands, suits, or loss, including all costs connected therewith, and for any damages which may be asserted, claimed or recovered against or from the City of Atlantic City, its elected and appointed officials, Its agents, employees, volunteers and Asbury Park Bazaar and Showboat Atlantic City and its’ members, by reason of personal injury, including bodily injury or death and/or property damage, including loss of use thereof, which arises out of or is in any way connected or associated with the entity’s use of Showboat Atlantic City and/or its participation in the Atlantic City Bazaar in general.
